Thank you for your email regarding H-1B visas. I appreciate hearing from you. 

Obviously, we all prefer that high-tech jobs be filled by American workers. H-1B visas are allocated to non-citizens, legally in the United States for a specific purpose for a temporary period of time. Any company seeking to admit such workers must first prove that there are no American workers available. If they cannot prove this, then no one enters the country. In short, these visas are available only where there is a clear showing that no Americans are available to fill the job. In addition, the events of September 11th have drastically changed the outlook for immigration reform in Congress, until national security issues can be addressed.

You may be interested in the High-Tech Work Fairness and Economic Stimulus Act (H.R. 3222) which would limit the number of H-1B visas, based on U.S. unemployment rates. This measure has been referred to the House Committee on the Judiciary. Although I do not sit on the committee with jurisdiction over this measure, please be assured that I will continue to monitor the post-September 11th changes in our economy, and will keep your thoughts in mind as the House considers immigration reform.
