DOJ OSC for Civil Rights The Department of Justice Office of Special Council, Civil Rights Division will investigate complaints of discrimination based on national origin and citizenship status.  The DOJ enforces United States Code Title 8 Section 1324b Unfair immigration-related employment practices.  You an complain about H-1B related discrimination to the DOJ.

OFCCP (OFCCP)  The Office of Federal Contract Compliance Programs enforces Executive Order 11246, As Amended.  Government contractors that don't comply with the EO 11246  can lose government contracts.  If you are complaining about discrimination that affected more than one person in your company, be sure to tell the OFCCP because they will investigate your charge as a class complaint.

INS

The INS can investigate complaints if illegal immigration activity.  The INS can investigate abuses of the  H-1B visa system.  The INS gets more complaints than they can handle.  After you complain to the INS I suggest you write your congressman or senators to inquire to the INS about your complaint.

The Law: INA § 212, INA § 235, INA § 271, INA § 272, INA § 273, INA § 274, INA § 274A, INA § 274C, INA § 275, INA § 277, and INA § 278.

Where to report illegal activity

 

DFEH   (DFEH)   The California Department of Fair Employment and Housing enforces the Fair Employment and Housing Act.  They have a one year statute of limitations for filing complaints of discrimination. Laws Enforced

EEOC (EEOC)  The Equal Employment Opportunity Commission enforces Title 7 of the Civil Rights Act of 1964 as amended.  The EEOC has a 300 day statute of limitations for discrimination complaints in California however,  statute of limitations may vary by state. Laws Enforced

DOL Wage & Hour The Department of Labor Wage and Hour Division is responsible for Enforcement of H-1B Labor Condition Applications.  H-1B related law enforced.

The Division of Labor Racketeering conducts investigations in three general areas:
